Applicant understands and acknowledges that the ADTP ELDP Operator Certification Program is not the only program available for the testing and training of delivery driver candidates, and applicant has chosen this program after careful consideration of the other programs available. Applicant understands that the success of each individual candidate depends on the aptitude of the particular candidate, the time and effort invested by the candidate, and the candidate’s ability to comprehend and retain the information contained in the ADTP program. As such, applicant understands that ADTP CANNOT AND DOES NOT GUARANTEE THE APPLICANT, NOR ANY APPLICANT, THAT HE/SHE WILL SUCCESSFULLY COMPLETE THIS PROGRAM. LIKEWISE, ADTP CANNOT AND DOES NOT GUARANTEE THE APPLICANT, NOR ANY APPLICANT, THAT HE/SHE WILL RECEIVE CERTIFICATION, OR THAT HE/SHE WILL BE PLACED AS A DELIVERY DRIVER. ADTP reserves the right to randomly re-test any applicant at the end of testing, if, in the sole discretion of ADTP, it deems necessary. ADTP reserves the right to disqualify any ELDP Operator or driver at any time if, in the sole discretion of ADTP, it deems necessary. Applicant agrees to indemnify, defend and hold harmless ADTP, Inc., its employees, agents, officers, shareholders and/or directors against any loss, liability, damage, cost or expense, including reasonable attorneys fees, arising out of any claims or suits brought against ADTP, Inc., its employees, agents, officers, shareholders and/or directors, which relate in any way to the applicant’s testing, training and/or certification as an ELDP Operator and/or delivery driver. Applicant further agrees to indemnify, defend and hold harmless ADTP, Inc., its employees, agents, officers, shareholders and/or directors against any loss, liability, damage, cost or expense, including reasonable attorneys fees, arising out of any claims or suits brought against ADTP, Inc., its employees, agents, officers, shareholders and/or directors, resulting from the applicant’s operation of a motor vehicle. ADTP, Inc. reserves the right to change or modify the above terms and conditions at any time without further notice.
